CRBJJ Waiver and Release

Release of Liability, Waiver & Indemnity Agreement

In consideration of being permitted to participate in the Martial Arts Program, as defined below, by CR Brazilian Jiu-Jitsu (“CRBJJ”), located at 5320 Wells Park Rd #1, Utah 84081, I, or if a minor, the parent(s) and/or legal guardian of the minor participant, agree to the following terms and conditions:

1. Voluntary Participation
   I voluntarily seek and consent to participate in CRBJJ’s Martial Arts Program. This program includes, but is not limited to, Brazilian Jiu-Jitsu, Judo, wrestling, Muay Thai, mixed martial arts (MMA), self-defense training, physical conditioning, and other related activities. I understand that some activities may involve body contact, chokes, joint locks, and striking. I also acknowledge that these activities may take place in various locations, and I have the choice not to participate in any event or competition offered by CRBJJ.

2. Physical Condition
   I represent that I am in proper physical condition to participate in the Martial Arts Program or accept full responsibility for my participation despite any existing medical conditions. I agree to disclose any relevant health conditions or concerns to CRBJJ prior to participation. Failure to disclose such conditions will release CRBJJ from liability for any resulting injuries or complications.

3. Acknowledgment of Risks
   I fully understand that participation in the Martial Arts Program involves inherent risks, including:

   • Bodily injury, partial or total disability, paralysis, or even death.
   • Economic losses, injuries, or damages that may be severe.
   • Risks from my own actions, the actions of others, or the condition of facilities and equipment.
   • Risks that may not be foreseeable at this time.
   • Close physical contact with other participants and the mats, which may involve skin-to-skin contact, is inherent to this sport. I acknowledge the risk of skin infections and illness associated with such contact, despite CRBJJ’s efforts to maintain a clean and hygienic facility.

4. Assumption of Risk
   I understand and accept these risks, whether known or unknown, and assume full responsibility for any injuries, losses, or damages resulting from my participation, even if caused by the actions or negligence of CRBJJ, its agents, or any other participants.

5. Use of Equipment and Facilities
   I acknowledge that I use CRBJJ’s equipment and facilities "as-is" and at my own risk. I hold CRBJJ harmless from any injuries, damages, or losses related to this use. I understand that I may request alternative equipment, but CRBJJ is not obligated to provide it.

6. Extracurricular Activities
   CRBJJ may host social or extracurricular events, which are voluntary. I agree that the terms of this Agreement apply to such activities, whether or not they are directly related to the Martial Arts Program.

7. Transportation
   If CRBJJ provides transportation to events or activities, I understand that participation is voluntary, and CRBJJ will not be liable for any injury, loss, or damage that occurs during such transportation. CRBJJ is not obligated to provide transportation.

8. Release of Liability
   I hereby release, waive, discharge, and covenant not to sue CRBJJ, its affiliates, owners, managers, staff, volunteers, landlords, property owners, agents, or any other associated parties, from any claims, demands, losses, or damages arising from participation in the Martial Arts Program or any related activities. This release includes, but is not limited to, injuries or accidents that occur within the facility, parking lot, walkways, or other areas associated with the CRBJJ property. This release also applies to any events, seminars, camps, practices, or other activities hosted by third parties who rent, lend, or lease the CRBJJ space. This release extends to my personal representatives, heirs, and next of kin.

9. Enforceability
   This Agreement is intended to be as broad as permitted by law. If any portion of this Agreement is found to be invalid or unenforceable, the remainder will remain in full force and effect.

10. Legal Fees
    In the event of a legal dispute related to this Agreement, I agree to pay for any attorney’s fees and costs reasonably incurred by CRBJJ in defending such a dispute.  - Payment Notice:
    By signing this waiver, I acknowledge that all card or direct debit payments may include a 3% processing fee to cover merchant service costs.

11. Relocation and Contract Cancellation
    If CRBJJ relocates, the terms of this Agreement remain in effect. For non-contract membership holders, a 30-day notice is required for cancellation. Contracted students may face an early termination fee, as outlined in the original agreement, regardless of the reason for cancellation.

12. Indemnity
    I agree to hold CRBJJ harmless and reimburse it for any costs incurred on my behalf.

13. Marketing Release
    I hereby grant CRBJJ permission to take photographs, video recordings, or other media of my participation in the Martial Arts Program, and I agree that CRBJJ may use these images and videos for promotional and marketing purposes, including but not limited to social media, websites, advertisements, and other marketing materials. I understand that these materials may be shared publicly, and I waive any right to inspect or approve the final product. I release CRBJJ from any liability arising from the use of these images or recordings.
